BOTTLEMART FARAWAY PROMOTION - CONDITIONS OF ENTRY




1.
Information on how to enter and prizes form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry. Entry is via Internet or SMS only.

2.
Entry is open only to residents of Australia aged 18 years or older who are able to travel to Barcelona, Spain between 4/5/2010 and 13/5/2010 ("Eligible Entrants"). The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies associated with this promotion are ineligible to enter the promotion.

Promotion starts at 9:00 am (Sydney time) on 22/11/2009 and ends at 11:59 pm (Sydney time) on 31/12/2009 ("Promotional Period"). The draw will take place at midday on 11/01/2010 at LIQUOR MARKETING GROUP LIMITED, Unit 16, 1 Burroway Rd, Homebush Bay, NSW 2127. Winners will be notified by telephone and in writing (mail or email, once contacted and their relevant mail or email information sourced). Winner's names and locality will be published in The Australian on 18/01/2010. The Promoter's decision is final and no correspondence will be entered into.

To enter the promotion, Eligible Entrants must purchase a 6 pack (6 bottles) or carton (24 bottles) of any James Boag pre-packaged product ("Eligible Purchase") at any participating retail Bottlemart outlet during the Promotional Period and either:

a.
log on to www.bottlemart.com.au ("Promotional Website") and correctly complete and successfully submit the online entry form, including providing the Eligible Entrant's full name, phone number, current and valid email address, date of birth, how they heard of the promotion and last 4 digits of the Eligible Purchase product barcode ; OR
b.
send an SMS in the required format to 0429 558 125 (to be charged at actual standard carriers' SMS communication costs as determined by the user's mobile phone provider) during the Promotional Period. The required SMS format is <firstname> <lastname> <postcode> <year of birth> <last 4 letters of barcode> e.g. John Citizen 3006 1972 8907.

5.
Maximum of 2 entries per person per day only however each entry must be based on a separate Eligible Purchase, submitted separately and must independently comply with these Conditions of Entry.

Eligible Entrants can enter only in their own name. Eligible Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Eligible Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Eligible Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm the Eligible Entrant's identity, age, residential address, eligibility to enter and claim a prize, that the Eligible Entrant obtained the bill payer's consent to enter by SMS before submitting their entry (if applicable), that the Eligible Entrant has a clear relationship with the end mobile device used to enter via SMS (if applicable), and any information submitted by the Eligible Entrant in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Eligible Entrant or entry has not been verified or validated to the Promoter's satisfaction then all the entries of that Eligible Entrant will be ineligible and deemed invalid.

7.
"Travel Prize": The first valid entry drawn from all eligible entries received will receive one (1) travel prize to Barcelona, Spain between 4/5/2010 and 13/5/2010 for the winner and one travel companion, valued at up to $20,000 (depending on point of departure). The prize includes:

a.
Two (2) adult return economy airfares to Barcelona, Spain from the Australian capital city closest to the ordinary residential address of the winner and includes airfare related taxes and charges;
b.
Six (6) nights at four (4) star accommodation in Barcelona, Spain and including hotel breakfast daily;
c.
Two (2) x three (3) day Spanish Grand Prix passes for two (2) people;
d.
Barcelona City Tour for two (2) people;
e.
return transfers to and from the destination airport and the accommodation;
f.
AUD$5,000.00 spending money (or local currency equivalent at the conversion rate published by Westpac Banking Corporation on the day of conversion) for the winner only; and
g.
Ten (10) days Covermore Option Travel Insurance for the winner and their travel companion.

8.
The dates and service providers for all travel services referred to in Condition 7 above will be determined at the sole discretion of the Promoter.

9.
Total maximum prize value is up to AU$20,000.00. The Travel Prize is not transferable or exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in Travel Prize value. All prize values are the recommended retail price including GST.

10.
Redemption of the Travel Prize may be subject to availability and dependent on airline travel class, specific room category availability and travel ‘blackout' periods. The Travel Prize must be booked and travelled in full by 13/5/2010, or is forfeited. No extension or variation of the travel dates nominated by the Promoter permitted. The winner and their travel companion may not accrue frequent flyer points. All components of the Travel Prize must be taken together and when offered or are forfeited. The winner will be responsible for any additional fees incurred by airlines or suppliers once booking is confirmed and ticketed. Travel and accommodation are to be arranged by licensed travel agent FCM Travel, Adelaide, or as nominated by the Promoter.

11.
The prize must be taken on the dates nominated by the Promoter to coincide with the Spanish Grand Prix, currently scheduled to take place on 7-9/5/2010, otherwise the entire prize is forfeited. No extension or variation of the travel dates nominated by the Promoter will be permitted. All components of the prize must be taken together. Any element of the prize not taken will be deemed to be forfeited.

12.
It is the sole responsibility of winner and nominated travel companion to ensure they have the necessary travel documents, passports and any necessary visas required by the date specified by the Promoter, or as and when requested by the nominated travel agent. Failure to do so could result in travel dates being missed and/or prize being forfeited.

13.
The winner acknowledges and agrees that motor racing is a dangerous activity. The winner also acknowledges and agrees that the Travel Prize is subject to any prevailing terms and conditions of the Grand Prix organisers (including but not limited to ground security and ticketing) as well as accommodation/transport/services/transfers or tour providers, and in particular, health, behaviour, age and safety requirements. No compensation will be payable if a winner, or their travel companions, are unable to use any element of the prize as stated for whatever reason, including refusal of entry or ejection from the Spanish Grand Prix or participation in certain activities for health, age, behaviour or safety reasons.

14.
Liability: The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking any prize or using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

15.
The person whose entry was drawn must confirm their eligibility to be awarded the prize within two (2) days of being successfully notified by the Promoter that they have been drawn, otherwise their entry will be deemed invalid. If the Eligible Entrant's entry is deemed invalid the Promoter will draw another Eligible Entrant at the same time of day and place as the original draw and repeat this process until a valid Eligible Entrant's entry is drawn. If the Promoter is unable to notify any Eligible Entrant drawn, the procedures outlined in this Condition and Condition 16 will apply.

16.
The Promoter may conduct a further draw at the same time of day and place as the original draw as is necessary on 19/2/2010 in order to distribute the prize if unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of any winner in the unclaimed prize draw, the winner will be notified by telephone and in writing (mail or email) and their name and locality will be published in The Australian on 26/2/2010.

17.
Eligible Entrants entering via SMS must be identified as having a clear relationship with the end mobile device (evidenced by Eligible Entrants entering by an SMS message originating from an MSISDN (unique mobile SIM number) that identifies the Eligible Entrant) and have the bill payer's consent to enter by SMS. Any form of automated entry using the Internet or any other device or software is invalid. Maximum SMS cost is $0.55 (including GST). Any SMS submitted after the Promotional Period has closed will not be included in the promotion and will be charged $0.55 cents (including GST). The charges for all SMS entry services will appear on each Eligible Entrant's next mobile phone bill. All queries relating to mobile bills should be directed to the Eligible Entrant's mobile phone carrier.

18.
A reply SMS will be sent to each Eligible Entrant after their entry has been received, confirming their entry has been successfully received, and whether entry is correct If an SMS entry is not successful because it is not in the required SMS format or the product barcode submitted by an Eligible Entrant is not recognised by the Promoter as an eligible product barcode for the promotion, a reply message will be sent to the Eligible Entrant. The reply message will prompt the Eligible Entrant to check their product barcode and resubmit their SMS entry in the required form. If the Eligible Entrant elects to resubmit their SMS entry, the Eligible Entrant will be charged a SMS cost at actual standard carriers' SMS communication cost as determined by the user's mobile phone provider.

19.
All other costs not disclosed in these Conditions of Entry including, but not only, additional meals, beverages, laundry services, additional spending money, transport to and from airport departure point, taxes (including applicable arrival and departure taxes), insurance, travel insurance, passports, visas and all other ancillary costs not expressly provided but incurred in acceptance and use of the Travel Prize are the responsibility of the winner and their travel companions. The Travel Prize cannot be used in conjunction with any other discounts or special offers. Use of any passes and vouchers issued as part of the Travel Prize are subject to prevailing terms and conditions of use.

20.
The winner of the Travel Prize is responsible for their entry, and the entry of their travel companion, into Spain, including obtaining (at the winner and their travel companion's expense) and holding, of any necessary passports and visas. The winner and their travel companion are responsible for obtaining (and the cost of obtaining) medical advice prior to taking the prize and obtaining any recommended vaccinations and immunisations in the manner required before travelling. Taking the Travel Prize is subject to any prevailing terms and conditions of use of any accommodation/transport/services/transfers or tour providers (as applicable), and in particular, health, behaviour, age and safety requirements. No compensation will be payable if the winner, or their travel companion, are unable to use any element of the Travel Prize as stated for whatever reason, including refusal of entry or departure into or out of Spain, refusal of entry into or ejection from any event or participation in certain activities for health, age, behaviour or safety reasons. Any part of the Travel Prize that is not taken for any reason is forfeited.

21.
Proof of purchase: Each Eligible Entrant must retain and may be required to present proof of each Eligible Purchase in order to claim a prize. An Eligible Entrant may be required to provide to the Promoter proof of purchase for all entries made. If an Eligible Entrant is unable to provide proof of purchase for all entries made within the required timeframes, then all the entries of that Eligible Entrant will be ineligible and deemed invalid. Proof of sale includes providing a photocopy of the store receipt for each Eligible Purchase made during the Promotional Period.

22.
Companion Identification: The Promoter reserves the right to request a winner's travel companion produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to, amongst other things, make necessary travel and associated bookings and applications.

23.
Legal Release: It is a condition of accepting a prize that the winner and their travel companion may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

24.
Verification: A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion. Prizes will be awarded only where the Eligible Purchase product barcode fulfils all of the requirements of the Promoter's verification tests and procedures. The verification tests and procedures shall be determined by the Promoter in its absolute discretion.

25.
Costs: Costs associated with accessing the promotion's website remain an Eligible Entrant's responsibility and may vary depending on the Internet service provider used. Contact details entered incorrectly on the website by an Eligible Entrant will be deemed an invalid entry. Please refer Condition 17 for SMS related costs.

26.
Time of entry - internet: Internet entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.

27.
The use of any automated entry software or any mechanical, electronic or other means that allows an Eligible Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Entrant invalid.

28.
Entry must be made via SMS (premium call rate applicable) using SMS (short messaging service) enabled mobile phones or via Internet. Some service providers and call plans may not provide access to premium SMS. Eligible Entrants must check with their service provider if unsure. SMS is not a guaranteed delivery communication tool. The Promoter and the service provider cannot accept responsibility for any SMS messages not received.

29.
Force Majeure: In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any other circumstance beyond the reasonable control of the Promoter, subject to any written directions made under applicable State or Territory legislation, the Promoter reserves the right to either provide an alternative travel prize (including an alternative destination at an alternative date as specified by the Promoter) to equal or greater value as the original prize or to cancel, terminate, modify or suspend the promotion.

30.
Caution: Any attempt to cause malicious damage or interference with the normal functioning of the SMS applications, the Promoter's website or the information on the website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an Eligible Entrant, the Eligible Entrant agrees to indemnify the promoter for those losses, damages and costs.

31.
Copyright and privacy generally: An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects personal information about an Eligible Entrant to include the Eligible Entrant in the promotion and, where appropriate, award prizes. If the personal information requested is not provided, the Eligible Entrant cannot participate in the promotion and is deemed ineligible.

32.
An Eligible Entrant also agrees that the Promoter may, in the event the Eligible Entrant is a winner, publish or cause to be published the winner's name and locality in any media, as required under the relevant State or Territory legislation. An Eligible Entrant can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter's Privacy Officer. All personal information will be stored at the office of the Promoter. A copy of the Promoter's Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.

33.
By participating in the promotion, an Eligible Entrant also acknowledges that a further primary purpose for collection of the Eligible Entrant's personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the Eligible Entrant in the future with information on special offers or to provide the Eligible Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact the Eligible Entrant with special offers in this way. By participating in the promotion, an Eligible Entrant acknowledges and agrees that the Promoter may use the Eligible Entrant's personal information in the manner set out in this condition.

34.
Alternative prizes: If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter's reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation.

35.
No liability: The Promoter and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to an Eligible Entrant's or any other person's mobile handset, computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.

36.
The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including but without limitation technical malfunctions or failures.

37.
If for any reason the promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or if necessary to provide an alternative prize or prizes of equal or greater value as an original prize or prizes, subject to any written directions made under applicable State or Territory legislation.

38.
Right to verify: The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Eligible Entrant for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Eligible Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

39.
Consent: As a condition of entering this promotion, an Eligible Entrant consents, in the event they are a winner, to the Promoter using the Eligible Entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Eligible Entrant agrees that, in the event they are a winner, the Eligible Entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
